Over the past six years I’ve discovered that:

1- Pulte Homes is dishonest, reckless and arrogant. They build shoddy houses and treat their customers poorly. These FACTS are documented in this website.

2- There is a virtual ARMY of Pulte supporters: real estate sales agents, stock brokers, contractors, subcontractors, suppliers, Twitter, etc. who KNOW that Pulte is a dishonest, reckless, and arrogant company that builds shoddy houses and treats customers poorly, but who promote Pulte for their own personal gain. They are, IMHO, SCUM OF THE EARTH.

3- There are MANY who have bought Pulte houses who have discovered that Pulte is a dishonest, reckless, and arrogant company that builds shoddy houses and treats customers poorly, who don’t speak the truth PUBLICLY about Pulte Homes. They want to sell their problem house to someone else. Needless to say, this is dishonest too.

I’ve done what I can to warn people about dishonest, reckless and arrogant Pulte Homes, and their dishonest supporters. To those who are considering purchasing a Pulte house, I hope that you do your homework first, and dig deep. The information is there, despite the efforts of those, including Twitter and Pulte house owners, who try to suppress it.

To those seemingly few who are NOT dishonest, SPREAD THE WORD, so that others don’t make the same mistake that we did.

This is how Pulte Homes connects roof trusses at Sun City Hilton Head, SC. The SC building code requires that houses at SCHH be capable of withstanding a 130 mph hurricane.

In articles by The Island Packet:

· Pulte installed hurricane clips at these connections BEFORE 2004 and AFTER 2007

· TWO THIRDS of the truss-to-truss connections in houses built between 2004 and 2007 that The Island Packet inspected had either one nail or NO nails or the substitute two nails were short, driven in split wood, or missed their target COMPLETELY

· Beaufort County, SC issued occupancy permits for houses here with KNOWN and documented, but uncorrected, defects

· In 2007 2,749 houses at SCHH built between 2004 and 2007 were re-inspected and repairs were made to 668 of them

· In 2009 The Island Packet reported that roof truss connections in BRAND NEW HOUSES here CONTINUE to be defective

Specific claims in the complaint include a number of unsafe conditions relating to the former quarry. Other claims include, but are not limited to, landscaping issues, safety issues, roof defects, roadway defects, sidewalk defects, grading issues and general construction issues.

Kudos to the Office of Arizona Attorney General Terry Goddard for protecting the rights of Arizona citizens. The Arizona AG's Office investigated Pulte’s pre-qualification practices, earnest money deposit policies and Spanish-language marketing efforts and determined that Pulte violated Arizona’s consumer protection law. As a result, Pulte Home Corporation and Pulte Mortgage, LLC (collectively “Pulte”) agreed to a $1,181,400 settlement with Arizona. The settlement includes:

Refund $81,400 to 10 Arizona consumers who the Attorney General alleged wrongly forfeited their earnest money deposits after canceling their purchase agreements.
Pay $200,000 into an escrow account which will fund any new, legitimate claims for earnest money deposit refunds that are filed with the Arizona Attorney General’s Office within 12 months of the settlement.
Pay $500,000 to the Consumer Fraud Revolving Fund to fund the Attorney General’s consumer protection, education and outreach programs.
Pay $100,000 to fund the publication and dissemination of Spanish-language educational materials.
Pay $300,000 as reimbursement of the Attorney General’s costs and investigative expenses.

A District Court judge has agreed to release 322 owners of duplexes in Sun City MacDonald Ranch from a multi-million dollar class action lawsuit regarding faulty plumbing.

The owners had been part of a separate construction defect lawsuit that settled in 2007 in which developer Del Webb Communities Inc., and its 34 subcontractors, paid more than $11.6 million.

On June 11, 2008, the United States lodged a settlement between the United States, Pulte Homes, and the States of Maryland, Tennessee, Colorado, and Nevada, and the Commonwealth of Virginia.

Pulte Homes was ranked the third largest home builder in the country in 2006 and the fourth largest builder in 2007 in terms of home closings and revenues.

EPA conducted inspections and gathered information for Pulte Homes construction sites located throughout the country.

The types and severity of alleged violations vary for each site but generally include:

discharge of polluted storm water to storm sewers or waterways without obtaining an NPDES permit;

failure to develop an adequate Storm Water Pollution Prevention Plan (SWPPP) for minimizing the amount of sediment and other pollutants in storm water runoff from the sites;

failure to install or implement appropriate storm water controls or best management practices (BMPs) required by the SWPPP (for example: silt fences were not installed in all required areas; BMPs to prevent sediment from entering storm drains were not installed; no BMPs were installed at construction entrances to prevent offsite trackout of dirt; concrete washout basins were not installed to prevent concrete from flowing into storm drains; portable toilets were located directly on top of storm drain inlets without BMPs to prevent spills from entering the storm drain);
incorrect installation of BMPs (for example: silt fences were not properly trenched in; sediment ponds were not completed prior to commencing site grading);
failure to keep BMPs in effective operating condition (for example: silt fences and storm drain inlet protections were full of sediment and no longer effective; silt fences had fallen down or had holes; construction entrances needed additional rock);

failure to adequately or routinely inspect BMPs to ensure proper operation and maintenance.
Pulte Homes has agreed to a settlement with the United States and the States of Maryland, Tennessee, Colorado, and Nevada, and the Commonwealth of Virginia to resolve these alleged violations.

Under this settlement, Pulte Homes will pay a civil penalty of $877,000, implement a Supplemental Environmental Project costing a minimum of $608,000, and implement a management and reporting system designed to provide increased oversight of on-the-ground operations and ensure greater compliance with the storm water requirements.

From the Pulte playbook:

1. When serious problems occur with Pulte houses (they do regularly): DENY, DENY, DENY.

2. Tell the homeowner:
"The roof trusses are OK", even though they're barely attached.
Tell them: "The wood floor is black because YOU, Mr. & Mrs. Homeowner, put a desk chair protector on it which didn't allow water COMING THROUGH THE SLAB to evaporate."
Tell them: "The stucco is OK", even though there are HUNDREDS of lawsuits.
Tell them: "The lagoons are 'happy and healthy'", even though there are plants growing and birds walking in the middle of them.
Give them ANY DUMB excuse that you can. Homeowners (especially old ones) are stupid. They'll believe you.

3. Cite J.D. Powers. Tell them: "If J.D. Powers says that Pulte houses are good, then they MUST be good." They're stupid. They'll believe it.

4. If all else fails, and you get one of the FEW homeowners who isn't stupid, then get the owner to sign an agreement so that they won't tell ANYONE (especially the press) about the problem. There may be 10,000 houses with the same defect; and, if the word gets out, then we may end up having to fix them ALL. This MUST be avoided at all cost.

Whether it comes to roofs, stucco, lagoons, wetlands, failed retaining wall, incorporation, golf course management, etc., you can count on Pulte’s response: deny, deny, deny.

The appropriate response from a responsible company is really quite simple: "We'll check it out". But, not Pulte.

The latest revelation that construction problems with roofs are STILL occurring MORE THAN TWO YEARS after they were first discovered, and supposedly fixed, illustrates perfectly Pulte’s dishonesty, recklessness, and arrogance.

Deny, deny. deny. And, discredit the private home inspector while you’re at it.

This is the kind of response that you expect from a little kid caught with their hand in the cookie jar: "I didn’t do it, Mommy."

Grow up, Pulte.

If Pulte concentrated on building good houses instead of concentrating on how to cover up their shoddy construction, then Pulte wouldn't need a playbook.

Dishonest, reckless, and arrogant Pulte Homes

When I retired and moved to Sun City Hilton Head, SC five years ago, I expected that the new house that I bought from Pulte Homes would be built to the normal standard of care. It wasn’t; and, MANY others weren’t either. Roof trusses are barely attached. Roofs leaked. Stucco was improperly mixed and applied. Pulte also did a poor job building community infrastructure—a collapsed retaining wall and stormwater lagoons that are poorly constructed, and an eyesore. All of this shoddy construction is well-documented herein.

I expected that Pulte would treat its customers well, as respected senior citizens. Instead, we’ve been treated like children. Pulte controls information that is given to residents through the community's slick publication, Sunsations, through emails, and by restricting information that is placed in lower mailboxes to only what Pulte approves. Pulte tells us what we should think on such issues as construction of our houses and community infrastructure, wetlands and other environmental concerns, incorporation of the community, golf course management, assessment fees, CC&Rs, etc. Pulte unilaterally changes CC&Rs without community input. Pulte fires chairmen of community committees and replaces duly-elected resident representatives on the community association board of directors with Pulte employees. The way that Pulte has run this community is an insult to the senior citizens who live here.

Needless to say, my retirement house and community haven’t turned out to be what I expected them to be. I have found Pulte Homes to be dishonest, reckless, and arrogant in their dealings here.

And, your government doesn’t protect you against shoddy construction, or dishonest, reckless, and arrogant builders.

I’m doing what I can to warn others, and, for change, so that others, including my children and grandchildren, won’t be subject to shoddy construction, and to dishonest, reckless, and arrogant builders.

Calling all law firms

Are you interested in a potential class action suit against a builder/developer with DEEP pockets?

At Sun City Hilton Head, SC builder/developer Pulte Homes has built thousands of houses that don’t meet the SC building code. Documented in this blogsite, http://peretired.blogspot.com/, are numerous newspaper articles that detail deficient roof truss connections, stucco, foundation slabs, etc.

Basically, the basis for the class action suit is that thousands of homeowners (including me) at SCHH signed contracts with Pulte Homes for constructing a new house. We expected that the houses would be built according to the SC building code. They were not. The resulting damages to homeowners include costs for remedial construction (replacing stucco, installing hurricane clips at roof truss connections, installing roof bracing, etc.) and the loss in value that has resulted from Pulte delivering a shoddily constructed house instead of the one that we contracted for (that meets minimum requirements of the SC building code). Some defects are probably hidden. Other defects, such as defective stucco and cracked foundation slabs, are VERY expensive to fix.

Beaufort County, SC may also be liable for damages in that they issued certificates of occupancy for houses with known defects. Recent newspaper stories contained in this blogsite (http://peretired.blogspot.com/) tell how deficient roof truss connections and bracing, which were first made public in 2007, were still occurring years later.

Extrapolation

Extrapolation is a scientifically proven method for taking data from a small group and applying findings to a much larger group. Engineers use extrapolation all the time. For example, engineers in manufacturing will examine and test "samples" from the production line to determine the quality (or lack thereof) of the larger group.

Other disciplines use the scientific process of extrapolation as well. Pollsters use data gathered from a small group to scientifically gain knowledge of a much larger group. Pollsters often cite “margin of error” in their findings, which uses statistics to determine the accuracy of their findings. Depending upon the size of the sample, “margin of error” for a relatively large population (people, things, observations, etc.) is usually only plus or minus a few percentage points from the data obtained from a relatively small sample set.

In a finished house much is covered up by walls, ceilings, floor finishes, etc. Only a small sample of the workmanship (or lack thereof) for the completed house can be seen. By extrapolating what is seen to what can't be seen, one can determine the workmanship (or lack thereof) of a house or group of houses.

I’ve seen enough shoddiness in Pulte's construction,

• substituting nails for hurricane clips
• then putting NO nails
• or 1 nail where there is supposed to be 2
• short nails
• in split wood
• missing its target, etc.
• leaking roofs
• shingles installed improperly

ANYONE who is the LEAST bit familiar with concrete construction knows that control joints are put in sidewalks and other concrete slabs on grade when they are poured to control future cracking. The slab is a little thinner, and weaker, at the control joint, so that is where it is most likely to crack.

SCHH mailboxes are all alike. They’re the rural type: metal mailbox on a wood post. The only differences are that in some neighborhoods the standard black mailboxes are on dark green wood posts. In others (like ours) the posts are painted black.

The Pulte-controlled HOA sends out a TYSK (Things You Should Know) email instructing homeowners to paint their mailboxes green.

Yes, that's correct--the email EXPLICITLY instructed homeowners to paint the MAILBOX (not the post) green. This, in fact, was verified when an HOA employee told a homeowner who lives across the street from us "The letter is the letter!"

Four in our neighborhood of approximately 100 homes painted their mailboxes green. Recently, the HOA did a routine, "CHICKEN SHIT" (seniors, take note), inspection and cited the four for their green mailboxes. They were told that they have 14 days to paint them black, or face the consequences ($$$ fine).

If things are looking up for mortgage insurers, then it's got to be a good time to buy homebuilders, too, right? There seems to be a consensus building that now's a good time to get into PulteGroup, Toll Brothers (NYS: TOL) , and KB Home (NYS: KBH) . Heck, even home prices turned up, rising 3.6% in the second quarter.

But look again at the rising level of delinquencies and foreclosures, the persistently high unemployment rate, and an economy that can't get its footing, and you'll see that the analysts thinking Pulte has more upside are simply whistling past the graveyard.

My Pulte tweets have been DISAPPEARING in Twitter "search". When I put "Pulte" in Twitter's search box, everybody's "Pulte" tweets appear except mine. It's now CLEAR--Twitter is part of the herd of pigs that feeds at Pulte Homes' trough.

So much for a "level playing field".
